In English Law schools all students start contract law with one case, Carlill v Carbolic Smoke Ball Company [1893]. The company advertised a payment of £10 if you used their smoke ball and subsequently caught flu. This case lays down clearly what is and what isn't a contract. BTW it's a good story if you're not interested in law.

Good advice. Something that wasn't called out well, just hinted at later in a response, was the question about how to do deal with the client "messing around". The response was to have the lawyers talk it out. And a bit later, Mike mentions about trying to preserve the relationship, and projects get weird, and things can be solved by a talk over coffee. I agree with all that, but overall, both of those responses are really giving advice multiple steps down the road after a project has been going off the rails. I was the director of delivery at a boutique consulting firm, and the first interview question I had with the owner was a very standard consulting scenario, "What do you do when you're six month into a project and it's now on fire/in red status?" That that question was their first told me exactly their pain point my position was trying to solve, and my direct response was, "I wouldn't let it get there in the first place, and that's accomplished by fixing your sales process." I did give the more direct answer to how to handle it, but I wanted to set the understanding that their problems weren't in the execution or delivery or people, their company problems were in their sales process, and first week on the job, I confirmed my assumptions. Their SOWs were a half page, with no clear deliverables or timeline, so of course things will get to that point on their projects, because there wasn't any alignment on the work, or checkpoints along the way. So I totally agree with Mike's content here, and to bolster some of the items less stressed, make sure your contract has clear deliverables AND timeline. He hit the deliverable point, but the timeline wasn't called out much, and that's key. Along with that, make sure you have outlined how you are going to work, and regular communication. In that, have two points of communication: one for regular project work/check ins, and another that's less frequent and higher level, that you can talk about the health of the project, and not get in the weeds on work. For project, could be anywhere from daily if doing something like SCRUM to weekly. For the health checkin, that would be monthly to quarterly, depending on the length of the project. And if you have enough people, have the first meetings be the team, and the second be the principle/client sponsor from your side that isn't in the day to day. That way, you hopefully can better "pop a level" and keep the convo about the relationship. And keep them even if things are going well! This is just like team one on ones. They aren't started when shit hits the fan. They are there to build relationships, so WHEN the shit hits, you have that relationship to have those coffee talks easier/better. So, TLDR, make sure you have a timeline, and make sure you make explicit time for curating the relationship explicitly. All those items are what keep you from having to deal with all that latter advice Mike had to answer, but do that too if it gets that far.

I like how he stumbles and lies about who his potential clients are that have, "for the most part, worked their butts off to hire a design crew." Dude, even you can't spit that out without sounding like you're lying, just quit it. The potential clients are wealthy, spoon-fed individuals who have always had money. It's like he doesn't want to say it.
